1. Acceptance of Terms
By accessing and using BuildFast.ai ("Service," "Platform," "we," "us," or "our"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
2. Description of Service
BuildFast.ai is an AI-powered platform that enables users to:
- Build and deploy SaaS applications without coding
- Use AI agents and autonomous builders
- Access templates and marketplace resources
- Export code and deploy to third-party platforms
- Integrate with payment processors and databases
3. User Accounts
3.1 Registration
You must create an account to use our Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3.3 Eligibility
You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you meet this requirement.
4. Subscription and Payment
4.1 Subscription Plans
We offer various subscription plans with different features and limitations. Current pricing is available on our pricing page.
4.2 Billing
Subscriptions are billed monthly or annually in advance. You authorize us to charge your payment method for the applicable fees. All fees are non-refundable except as required by law or as explicitly stated in these Terms.
4.3 Cancellation
You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. You will retain access to your account and data but cannot build new applications after cancellation.
4.4 Price Changes
We reserve the right to change our prices with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new prices.
5. Code Ownership and License
5.1 Your Code
You own all rights to the code generated for your applications. We grant you a perpetual, worldwide, non-exclusive license to use, modify, and distribute the generated code.
5.2 Platform License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service during your subscription period.
5.3 Templates and Resources
Templates and resources provided through our marketplace may have separate licenses. Review individual template licenses before use.
6. Acceptable Use
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Infringe upon intellectual property rights of others
- Transmit malware, viruses, or harmful code
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service
- Use the Service to create spam or phishing content
- Resell or redistribute the Service without permission
7. Third-Party Services
Our Service integrates with third-party services (e.g., Stripe, Supabase, Vercel). Your use of these services is subject to their respective terms and conditions. We are not responsible for third-party services or their availability.
8. Data and Privacy
Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.
9. Intellectual Property
The Service, including its original content, features, and functionality, is owned by BuildFast.ai and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. USE OF THE SERVICE IS AT YOUR OWN RISK.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDFAST.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
12. Indemnification
You agree to indemnify and hold harmless BuildFast.ai and its affiliates from any claims, damages, losses, liabilities, and expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.
13. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:
- Breach of these Terms
- Non-payment of fees
- Violation of applicable laws
- Suspicious or fraudulent activity
Upon termination, your right to use the Service will immediately cease. You may export your data before termination.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of San Francisco County, California.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
